The online sales site BAOLGICHIC was set up by the company BAOLGI, which is the operator of this site.
Any order placed for a product appearing on the website www.BAOLGICHIC.com implies prior consultation of these general terms and conditions of sale.
The act of placing an order implies the customer's full and unreserved acceptance of these general terms and conditions of sale.
Consequently, the customer acknowledges being perfectly informed of the fact that their agreement regarding the content of these general terms and conditions of sale does not require the handwritten signature of this document, insofar as the customer wishes to order the products presented within the framework of the website www.BAOLGICHIC.com online.
The customer has the option to save or print these general terms and conditions of sale, it being specified that both the saving and printing of this document are their sole responsibility.
The seller reserves the right to modify these general terms and conditions of sale at any time. Consequently, it is up to the customer to ensure, at the time of each order, that they have the latest general terms and conditions of sale in force and permanently available on the website www.BAOLGICHIC.com
ARTICLE 1
The SARL BAOLGI is the owner of the site www.BAOLGICHIC.com in its entirety. Any reproduction, in whole or in part, is systematically subject to BAOLGI's authorization. However, hypertext links to the site are authorized without specific requests.
ARTICLE 2 - PRODUCT INFORMATION
BAOLGI undertakes to take the greatest care in putting information relating to the essential characteristics of the products online on the site www.BAOLGICHIC.com.
The photographs and graphics illustrating the products on the site www.BAOLGICHIC.com or the emails sent by BAOLGICHIC are mainly those transmitted by the manufacturers, and these representations strive to be as faithful as possible. A difference in perception regarding colors and shapes between the photographs and the products cannot engage BAOLGI's liability.
Only the essential characteristics of the products are mentioned on the site. The customer is invited to read the instructions for use and any other information attached to the products or marked on their packaging (assembly instructions, conditions of use, precautions for use, etc.).
ARTICLE 3 - PRICE
The selling prices indicated on the site are in euros and include all taxes but exclude delivery costs, subject to a typographical error or manifest IT labeling error.

The prices displayed on the site are subject to change at any time.
The applicable price is that indicated on the site on the date the order is recorded by the customer.
Delivery costs are indicated to the customer at the end of the order in addition to the price of the selected products.
The amount of delivery costs is set according to the amount of the basket.
ARTICLE 4 - PLACING ORDERS
4.1. Creation of the customer account
4.1.1. The transmission of an order by the Customer to BAOLGICHIC implies the communication by the Customer to BAOLGICHIC of identification data such as surname, first name, postal address, and email address.
4.1.2. The creation of a customer account by the Customer is optional. In the event that the Customer wishes to create a customer account, they must choose a username and password.
4.1.3. As the information communicated by the Customer is essential for the processing and routing of their order, the establishment of invoices and warranty contracts, the absence of this information will result in the cancellation of the order transmitted by the Customer to BAOLGICHIC.
4.2. Methods of transmission of the Customer's order
In order to allow the Customer to place an order, BAOLGICHIC makes the following means available to them:
- via the Internet on the BAOLGICHIC site or associated internet platforms 24/7
- by telephone at 06 26 97 27 73; the Customer must then indicate to the operator the references of the product appearing in the product sheet, and any options such as colors, sizes, etc.
Our customer service is open from Monday to Friday from 8:30 am to 12:30 pm and from 2:00 pm to 5:00 pm.
All information regarding possible closures (public holidays, leave, etc.) of our warehouses and sales department will be mentioned on the site in the NEWS section.
4.3. Confirmation of the order by BAOLGICHIC
4.3.1. Any order transmitted by the Customer to BAOLGICHIC will be the subject of a confirmation sent to the Customer by email to the address indicated by the Customer within a maximum of 48 hours from receipt of the order. The order confirmation will be considered validly carried out even if the email address provided by the Customer is incorrect.
4.3.2. Failing confirmation by BAOLGICHIC, the Customer's order will be considered as not received by BAOLGICHIC.
4.3.3. Only the effective payment of the order by the Customer and the acceptance of these general terms and conditions of sale will result in the final validation of the order.
4.3.4. However, BAOLGICHIC reserves the right to refuse any order transmitted by a Customer for whom there is an order or payment dispute until this situation is regularized.
ARTICLE 5 - AVAILABILITY OF PRODUCTS
5.1. No order may be transmitted to BAOLGICHIC by the Customer for a product that is not in stock on the date of confirmation of the order.
5.2. In the event of a stock shortage occurring between the time of the order and its receipt by BAOLGICHIC, BAOLGICHIC undertakes to inform the Customer within 48 hours and to offer them the choice of:
- either the cancellation and refund of the order,
- or the shipment of a similar product of equivalent quality and price.
ARTICLE 6 - SECURE PAYMENT OF ORDERS
6.1. BAOLGICHIC makes several payment methods available to the Customer:
Payment by credit card: BAOLGICHIC or any trusted third-party intermediary such as PAY PAL or a banking institution acting on its behalf will debit the Customer's credit card for the total price of the order (including delivery costs). Failing authorization to debit the Customer's credit card, the Customer's order cannot be accepted by BAOLGICHIC.
Online payment by credit card is carried out via the PAY PAL security system which allows for the secure encryption of banking details during their transmission over the network; BAOLGICHIC does not keep any banking information of its clients.
Payment by check made out to the order and address listed on the site. No shipment of the order will be made by BAOLGICHIC before receipt of the check by BAOLGICHIC, which may take several days.
6.2. In the context of the fight against payment fraud, BAOLGICHIC verifies the reliability of the information entered by the Customer when recording their order.
BAOLGICHIC's Customer Service may ask the Customer for additional information (identity card, proof of address) in order to validate the purchase and shipment of the parcel.
ARTICLE 7 - SHIPPING AND DELIVERY TIMES
7.1. Place of delivery
The products ordered by the Customer on the BAOLGICHIC site can be delivered to Metropolitan France including Corsica, the DOM TOM, and other countries.
7.2. Delivery date
The estimated delivery date is determined based on the following 3 elements:
- The order validation times (24 to 48 hours maximum) corresponding to the times for confirming payment of the order and possible verification of the Customer's personal data, - The order shipping time (see below 7.3) - The delivery time which depends on the delivery method chosen by the client and the country in which the delivery must be made. Delivery times are detailed at this location (link on the delivery page of the site)
7.3. Delivery times for products in stock
7.3.1. When the Customer's order is transmitted and confirmed by BAOLGICHIC before 12:00 PM - Paris time - from Monday to Friday, excluding public holidays and weekends, the shipment of the order will be carried out by BAOLGICHIC within 48 hours at the latest.
7.3.2. Any order transmitted by the Customer and validated by BAOLGICHIC after 12:00 PM - Paris time - from Monday to Friday, excluding public holidays and weekends will be shipped within 72 hours.
7.3.3. For any order transmitted to BAOLGICHIC during public holidays or leave (information in the NEWS section), the shipping time will not exceed 7 working days following the date of validation of the order.
7.3.4. In the event of a delivery delay of more than 7 (seven) days, with regard to the delivery deadline announced by BAOLGICHIC, the Customer has the possibility to cancel the order concerned by registered letter with acknowledgment of receipt.
7.3.5. In this hypothesis, BAOLGICHIC undertakes to reimburse the Customer for the sums paid within a period of 30 (thirty) days from the date of payment of the order.
7.3.6. The delivery times cited above are not valid for Corsica, the DOM TOM, and other countries. The delivery time will be defined according to each order and final destination.
ARTICLE 8 - DELIVERY METHODS
8.1. No order will be shipped by BAOLGICHIC in the absence of payment of the full price unless promotional or marketing operations provide otherwise.
8.2. The order will be delivered to the address indicated by the Customer upon validation of the order and handed over against signature.
8.3. In the event of the absence of the Customer or the recipient of the parcel in the case of delivery to a different address, the carrier will leave a calling card allowing the parcel to be collected.
8.4. BAOLGICHIC cannot consequently be held responsible for delays, defects, or delivery problems that could result from the provision of erroneous information by the Customer.
8.5. In the event of non-receipt of a parcel within the indicated deadlines, and once informed by the Customer, BAOLGICHIC will open an investigation with its carrier.
8.6. The Customer will then receive an email indicating that an investigation is open. The carrier's final response times are generally 14 to 21 working days.
8.7. If the parcel is found, it is then sent to the Customer. The delivery procedure described above will follow its normal course.
8.8. If the parcel is declared lost, BAOLGICHIC will then notify the Customer and proceed with the formalities for exchange or refund of the order corresponding to the lost parcel (products and shipping costs).
ARTICLE 9 - CONFORMITY OF PRODUCTS
9.1. Upon receipt of the order, the Customer must verify the conformity of the products delivered with the order transmitted to BAOLGICHIC and the good condition of the products delivered.
9.2. Where applicable, the Customer (or their representative) must indicate to the carrier on the delivery slip and in the form of handwritten reservations accompanied by their signature, any anomaly concerning the parcel or the items delivered (shock, damage to the parcel, delivery date not compliant with normal delivery service times, ...).
9.3. In the event that such mentions have not been made on the delivery slip presented to the Customer by the carrier, no claim relating to the condition of the parcel(s) could be accepted a posteriori by BAOLGICHIC.
ARTICLE 10 - IN WHICH CASES TO RETURN A PRODUCT
10.1. Withdrawal period:
Under the provisions of Article L.121-20 of the Consumer Code, the Customer has the possibility to return to BAOLGICHIC any item that does not meet their expectations within a period of 7 (seven) days from the date of delivery.
The return costs of the returned goods remain the responsibility of the customer.
The refund will be made by check or bank transfer no later than thirty days following the date on which this right was exercised.
10.2. Warranty
In the event of a defect preventing normal use of the product delivered by BAOLGICHIC, it may be returned under the contractual warranty.
All our products are guaranteed for one year against any manufacturing defect.
In this case, the costs of returning the product ordered and delivered to the client, as well as the possible delivery of another product, will be borne by BAOLGICHIC.
Attention: products arriving deteriorated do not fall into the category of returns linked to the right of withdrawal or defective products and must be the subject of special mentions to the carrier issued upon receipt of the parcel.
ARTICLE 11 - RETURN PROCEDURE
11.1. How to return a product to us

You will receive a return number for your product within 48 business hours.
11.2. Where to send the product back
The merchandise must be sent to us packaged and insured with the carrier for the market value of the product. These precautions are necessary in case of deterioration or loss of the merchandise by the carrier.
Small items can be returned to us by post.
For larger products, we can give you the contact details of the carriers we work with.

The right of return can only be accepted for products in their original condition and complete (original packaging, possible accessories, documentation).
Products returned incomplete, spoiled, damaged, or soiled by the client will not be taken back.

11.3. Refund
Upon receipt of the return parcel, we proceed to check the returned products to determine if they meet the return conditions.
When the return is validated, you will receive a message proposing:
Either an exchange for an identical product
Either an exchange for another product of similar value within the limit of our stocks
Or a refund
BAOLGICHIC undertakes to refund you by check or bank transfer within a maximum period of 30 days from the day the right was exercised.
ARTICLE 12 - WARRANTIES
12.1. The products marketed by BAOLGICHIC benefit from:
The legal warranty against hidden defects,
The legal guarantee of conformity,
under the conditions provided for in Articles 1641 and 1649 of the Civil Code.
CIVIL CODE
Article 1641
The seller is bound by the warranty on account of the hidden defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would only have paid a lesser price for it, had they known of them.
Article 1649
The action resulting from redhibitory defects must be brought by the purchaser within a period of two years from the discovery of the defect.
CONSUMER CODE
Article L211=4
The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. They are also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was made their responsibility by the contract or was carried out under their responsibility.
Article L211=5
To be in conformity with the contract, the good must:
1° Be fit for the use usually expected of a similar good and, where applicable:
- correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;
- present the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;
2° Or present the characteristics defined by mutual agreement by the parties or be fit for any special use sought by the buyer, brought to the seller's knowledge and which the latter has accepted.
Article L211=12
The action resulting from the lack of conformity is prescribed by two years from the delivery of the good.
12.2. In the event of a defect preventing normal use of the product delivered by BAOLGICHIC, the Customer may return the defective item accompanied by a copy of the invoice, the warranty slip, and the return number obtained in accordance with the procedure detailed in Article 11.1.
12.3. The Customer may request from BAOLGICHIC, at their choice:
- the delivery of a product identical to that ordered, within the limits of available stocks;
- the delivery of a product of equivalent quality and price, within the limits of available stocks;
- the refund of the price of the product on the date of the order within 30 (thirty) days following their request.
ARTICLE 13 - DISPUTE AND LIABILITY
13.1. BAOLGICHIC cannot be held liable for the non-performance of the contract concluded:
- in the event of force majeure, blockage of telecommunications networks, strike, national or local state of emergency, bad weather without this list being exhaustive and,
- in the event of fault by the client
- due to the unpredictable and insurmountable act of a third party to the contract.
13.2. BAOLGICHIC cannot be held liable for consequences resulting from the misuse of products sold on the Site.
ARTICLE 14 - PROTECTION OF PERSONAL DATA
14.1. Personal data
14.1.1. BAOLGICHIC collects and records information relating to the Customer, a natural person, constituting personal data. This data is recorded in an internal database.
14.1.2. Subject to the Customer's express agreement formalized during the creation of their customer account, BAOLGICHIC will send the latter newsletters and promotional emails proposing new items, clearance offers, exclusives, good deals...
14.1.3. At any time, the Customer may ask to no longer receive emails, either by clicking on the link provided for this purpose in the emails, or by logging into their customer area, or by sending an email to Customer Service at the following address: g.humez@baolgi.com
14.1.4. If the Customer has expressly accepted it when registering on the Site, BAOLGICHIC and its contractual partners may send them information within the framework of specific and punctual promotional operations.
14.1.5. During each purchase, the Customer may oppose the communication to third parties and the use by BAOLGICHIC of their contact details for the operations described above.
14.1.6. In application of Law No. 78-17 "Informatique et Libertés" of January 6, 1978, the Customer benefits permanently from a right of access and rectification on all personal data communicated to BAOLGICHIC.
14.2. Cookies
14.2.1. In the context of consulting or using the Site, BAOLGICHIC may keep certain data concerning the Customer, for the needs of the proper functioning of the services offered as well as for statistical purposes.
14.2.2. Activation of this function is not necessary to visit the Site.
ARTICLE 15 - INTELLECTUAL PROPERTY
15.1. The name BAOLGICHIC has been filed by BAOLGI as a Community trademark and registered.
15.2. The Community trademark BAOLGICHIC and the domain name BAOLGICHIC.com, its regional or thematic derivatives, constitute protected names belonging to BAOLGI.
15.3. Any use of the term BAOLGICHIC is prohibited without the prior written authorization of BAOLGI.
15.4. The Sites and their contents are protected, within the meaning of the Intellectual Property Code, in particular by copyright and trademark rights.
15.5. In application of the Intellectual Property Code and, more generally, international treaties and agreements containing provisions relating to the protection of copyright, the Customer is prohibited from reproducing even partially, selling, distributing, issuing, broadcasting, adapting, modifying, publishing, communicating in full or in part, in any form whatsoever, the presentation or organization of the Sites without the prior written authorization of BAOLGI.
15.6. Any violation of the rights and obligations listed above would constitute an infringement of BAOLGI's intellectual property rights.
ARTICLE 16 - ACCESS TO THE SITE
16.1. Access to all or part of the Site may be suspended or deleted upon simple decision by BAOLGICHIC in the event of force majeure, computer or technical difficulties, difficulties related to the structure of telecommunications networks, blockage of telecommunications networks, strike, national or local state of emergency, bad weather without this list being exhaustive.
16.2. Similarly, access to the Site may be interrupted for maintenance reasons.
16.3. The Site is subject to modifications and developments including at the level of functionalities at any time and without prior notification of any kind and without the Customer being able to invoke any prejudice.
ARTICLE 17 - APPLICABLE LAW AND JURISDICTION
17.1. These general terms and conditions of sale and any contract concluded by virtue of these presents are subject to French law.
17.2. Any dispute relating to the validity, interpretation, and/or execution of these presents and any contract concluded with a merchant or a commercial company is subject to the jurisdiction of the Courts of Nantes.
